OVERVIEW
Welcome to Chewi. The terms "we", "us" and "our" refer to Chewi.
Chewi operates this store and website, including all related
information, content, features, tools, products and services in
order to provide you, the customer, with a curated shopping
experience (the "Services"). Chewi is powered by Shopify, which
enables us to provide the Services to you.

These Terms of Service, together with any policies referenced
herein, describe your rights and responsibilities when you use
the Services. Please read them carefully — they include important
information about your legal rights and cover areas such as
warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree
to be bound by these Terms of Service and our Privacy Policy. If
you do not agree, you should not use or access our Services.

Nothing in these Terms limits any statutory rights you have as a
consumer under European Union or Dutch law, including your right
of withdrawal within 14 days of receiving your order (see our
Refund Policy for details).

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least
the age of majority in your country of residence, and you have
given us consent to allow any minor dependents to use the
Services on devices you own or manage.

To use the Services — including browsing our store or purchasing
products — you may be asked to provide information such as your
email address, billing, payment, and shipping information. You
represent that all information you provide is correct, current
and complete, and that you have all rights necessary to provide
it. You are solely responsible for maintaining the security of
your account credentials and for all activity on your account.
You may not transfer, sell, assign, or license your account to
any other person.

SECTION 2 - OUR PRODUCTS
We make every effort to represent our products accurately. Note
that colors or product appearance may differ from how they
appear on your screen due to device settings. We do not warrant
that the appearance of any product will be identical to how it
is depicted online.

All product descriptions are subject to change without notice at
our sole discretion. We reserve the right to discontinue any
product at any time and to limit the quantities available to any
person, region, or jurisdiction on a case-by-case basis.

Chewi products are dietary supplements. They are not intended to
diagnose, treat, cure, or prevent any disease and are not a
substitute for a varied and balanced diet or a healthy
lifestyle. If you are pregnant, breastfeeding, taking medication,
or have a medical condition, consult your doctor before use.

SECTION 3 - ORDERS
When you place an order, you make an offer to purchase. Chewi
reserves the right to accept or decline your order at its
discretion. Your order is accepted only when Chewi confirms
acceptance and we have received your payment. Please review your
order carefully before submitting — Chewi may be unable to
accommodate cancellation requests after an order is accepted.

Your purchases are subject to return or exchange in accordance
with our Refund Policy. Nothing in these Terms limits your
14-day EU right of withdrawal, as described in the Refund
Policy.

You represent that your purchases are for personal or household
use only, not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without
notice. The price charged will be the price in effect at the
time you place your order, as shown in your order confirmation
email. Prices displayed include applicable Dutch VAT (BTW) at
the standard rate. Shipping is added at checkout.

You agree to provide current, complete and accurate purchase,
payment, and account information, and to promptly update it
(including email address and payment details) so we can complete
your transactions.

You represent that (i) the payment information you provide is
true and complete, (ii) you are authorized to use the payment
method, (iii) charges will be honored, and (iv) you will pay all
charges at posted prices, including shipping and applicable
taxes.

SECTION 5 - SHIPPING AND DELIVERY
See our Shipping Policy for delivery regions, rates, and
estimated times. All delivery times are estimates and are not
guaranteed. We are not responsible for delays caused by shipping
carriers or events outside our control. Once we transfer
products to the carrier, title and risk of loss pass to you.

Chewi ships to the Netherlands, Belgium and Germany only.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services — including all trademarks, brand names, text,
displays, images, graphics, product reviews, video, and audio,
and the design, selection and arrangement thereof — are owned
by Chewi, its affiliates or licensors and are protected by
Dutch, EU and international copyright, trademark and other
intellectual property laws.

These Terms permit you to use the Services for personal,
non-commercial use only. You must not reproduce, distribute,
modify, create derivative works of, publicly display, publicly
perform, republish, download, store, or transmit any material
from the Services without our prior written consent.
Unauthorized use may be a violation of applicable IP laws. All
rights not expressly granted are reserved by Chewi.

The Chewi name, logo, product and service names, designs, and
slogans are trademarks of Chewi. Shopify's name and logo are
trademarks of Shopify. All other names, logos, product and
service names, and designs on the Services are trademarks of
their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by
third parties as part of the Services, which we neither monitor
nor control. We provide access to such tools "as is" without any
warranties. Your use of any optional third-party tool is
entirely at your own risk, and you should review that
third-party provider's terms.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to third-party sites. We are not
responsible for their content or accuracy. Complaints regarding
third-party products or services should be directed to the
third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Chewi is powered by Shopify, which enables us to provide the
Services to you. Any sales and purchases you make are made
directly with Chewi. By using the Services, you acknowledge
that Shopify is not responsible for any aspect of any sales
between you and Chewi, including any injury, damage, or loss
resulting from purchased products. You expressly release Shopify
and its affiliates from all claims arising from your purchases
with Chewi.

SECTION 10 - PRIVACY POLICY
All personal information we collect is subject to our Privacy
Policy, and certain personal information may be subject to
Shopify's Privacy Policy. By using the Services, you acknowledge
you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and
processes personal information about your access to and use of
the Services. Information you submit may be transmitted to
Shopify and third parties, potentially in countries outside your
own. See our Privacy Policy for details.

SECTION 11 - FEEDBACK
If you submit any ideas, suggestions, feedback, reviews or other
content ("Feedback"), you grant us a perpetual, worldwide,
sublicensable, royalty-free license to use, reproduce, modify,
publish, distribute and display such Feedback in any medium,
including for commercial use.

You represent that (i) you own or have all necessary rights to
your Feedback, (ii) you have disclosed any compensation received
in connection with it, and (iii) your Feedback complies with
these Terms. We are under no obligation to keep Feedback
confidential, pay compensation, or respond to it. We may (but
have no obligation to) monitor, edit or remove Feedback we deem
unlawful, offensive or otherwise objectionable.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
The Services may contain typographical errors, inaccuracies or
omissions relating to product descriptions, pricing, promotions,
shipping charges, transit times and availability. We reserve the
right to correct any errors and to change, update or cancel
orders at any time without prior notice (including after
submission).

SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only.
You may not access or use the Services: (a) for any unlawful or
malicious purpose; (b) to violate any EU, Dutch, or applicable
international laws or regulations; (c) to infringe our
intellectual property rights or those of others; (d) to harass,
abuse or harm any person; (e) to transmit false or misleading
information; (f) to send unsolicited advertising or spam; (g) to
impersonate any person or entity; or (h) to interfere with the
Services or expose us or Shopify to liability.

You also agree not to: (a) upload viruses or malicious code;
(b) reproduce, copy or resell any portion of the Services;
(c) collect personal information of other users; (d) spam,
phish, or pretext the Services; (e) use any robot, scraper, AI
tool, or automated means to access the Services; or
(f) circumvent security measures. We may suspend or terminate
your account at any time if you violate these Terms.

SECTION 14 - AGENTS
This section applies if you use, allow, or cause the deployment
of an Agent to interact with the Services. "Agent" means any
software or service that takes autonomous or semi-autonomous
action on behalf of a person or entity without direct
supervision.

No Agent may access, use, or interact with the Services unless
it identifies itself in strict accordance with the requirements
below. Agents must:
  (i) in all HTTP/HTTPS requests, identify that the request is
      from an Agent by including "Agent/[agent name]" in the
      user agent string;
  (ii) not conceal or obfuscate their access, mimic human
       behavior, complete CAPTCHAs, or circumvent measures
       intended to distinguish humans from bots;
  (iii) respond truthfully to any prompt asking whether the
        interaction is human or automated;
  (iv) not circumvent any measure intended to block, limit, or
       control Agent access.
We may limit, including by technical measures, whether and how
any Agent accesses the Services.

SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services
at our sole discretion at any time without notice, and you
remain liable for all amounts due up to termination. The
sections on Intellectual Property, Feedback, Termination,
Disclaimer of Warranties, Limitation of Liability,
Indemnification, Severability, Waiver, Assignment, Governing
Law, and Privacy Policy will survive termination.

SECTION 16 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made
available solely for general information purposes. We do not
warrant its accuracy, completeness, or usefulness. Any reliance
you place on it is at your own risk.

Except as expressly stated by Chewi, the Services and all
products offered are provided "as is" and "as available",
without any representations, warranties or conditions of any
kind, express or implied, including implied warranties of
merchantability, fitness for a particular purpose, or
non-infringement. This does not limit your statutory rights as
a consumer under Dutch or EU law, including the right to expect
conforming goods under the EU Sale of Goods Directive.

SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Chewi, our partners,
directors, officers, employees, affiliates, agents, contractors,
service providers and licensors, and those of Shopify and its
affiliates, shall not be liable for any indirect, incidental,
punitive, special or consequential damages of any kind,
including lost profits, lost revenue, lost savings or loss of
data, arising from your use of the Services or any products
purchased through them.

Nothing in this section limits our liability for death or
personal injury caused by our negligence, for fraud, or for any
other liability that cannot be excluded under applicable law.
Our total liability to you for any claim under these Terms
shall not exceed the amount you paid for the product giving
rise to the claim.

SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless Chewi, Shopify, and
our respective affiliates, officers, directors, employees,
agents and licensors from any losses, damages, liabilities or
claims arising from (1) your breach of these Terms, (2) your
violation of any law or the rights of a third party, or (3) your
access to and use of the Services.

SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful,
void or unenforceable, that provision will be enforceable to
the fullest extent permitted by law, and the unenforceable
portion will be severed. The remaining provisions will continue
in effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right under these Terms
does not constitute a waiver. These Terms, together with any
policies posted on our site, constitute the entire agreement
between you and Chewi and supersede any prior agreements.

SECTION 21 - ASSIGNMENT
You may not assign or transfer these Terms without our prior
written consent. We may assign our rights and obligations
without notice to you.

SECTION 22 - GOVERNING LAW
These Terms and any separate agreement whereby we provide you
Services are governed by and construed in accordance with the
laws of the Netherlands. Any dispute arising out of or in
connection with these Terms shall be subject to the exclusive
jurisdiction of the competent courts in the district of
Limburg, the Netherlands, unless mandatory consumer protection
laws provide otherwise.

EU consumers have the right to submit disputes to the European
Commission's Online Dispute Resolution platform:

SECTION 23 - HEADINGS
Headings used in these Terms are for convenience only and do
not limit or affect the Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE
You can review the most current version of these Terms at any
time on this page. We reserve the right to update, change or
replace any part of these Terms by posting updates on our
website. Material changes will be notified to you as required
by applicable law. Your continued use of the Services after
changes constitutes acceptance of those changes.
